These Terms of Service ("Terms") govern your access to and use of the website and services provided by LNT MEDIA LLC ("LNT MEDIA," "we," "us," or "our"). By using our website or engaging our services, you agree to these Terms.
1. Services
LNT MEDIA provides digital marketing services, which may include strategy, social media management, advertising, content, email marketing, and analytics. The specific scope, deliverables, fees, and timeline of any engagement are defined in a separate proposal or service agreement between you and LNT MEDIA. Where those documents conflict with these Terms, the signed service agreement controls.
2. Client responsibilities
- Provide accurate information and timely access to accounts, assets, and approvals needed to perform the services.
- Ensure you have the rights to any materials you provide to us.
- Comply with the advertising and content policies of any third-party platforms used in your campaigns.
3. Fees and payment
Fees are described in your proposal or service agreement. Invoices are due as stated in that agreement. Late or missed payments may result in suspension of services. Advertising spend payable to third-party platforms is separate from our service fees.
4. Intellectual property
Upon full payment, deliverables created specifically for you become your property, except for any pre-existing materials, tools, or processes that remain owned by LNT MEDIA. We may reference completed work in our portfolio and marketing unless you request otherwise in writing.
5. Confidentiality
Each party agrees to protect the other's confidential information and to use it only for the purpose of the engagement.
6. Results disclaimer
Marketing outcomes depend on many factors outside our control, including market conditions and third-party platforms. We perform our services with professional skill and care, but we do not guarantee specific results such as rankings, traffic, leads, sales, or revenue.
7. Limitation of liability
To the maximum extent permitted by law, LNT MEDIA is not liable for indirect, incidental, or consequential damages. Our total liability for any claim relating to the services will not exceed the amount you paid to us for the services giving rise to the claim in the three months preceding it.
8. Termination
Either party may terminate an engagement as described in the applicable service agreement. Fees for work performed up to the termination date remain payable. Refunds, where applicable, are governed by our Refund Policy.
9. Governing law
These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law principles. Any disputes will be subject to the courts located in New Mexico.
10. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of our website or services after changes take effect constitutes acceptance.
